1.1 Data Controller

1.3 Legal Basis for Processing

1.4 Purpose of Data Processing
Your personal data is processed for the following purposes:

1.5 Data Retention
We retain personal data only for as long as necessary to fulfil the purposes for which it was collected. Project-related data is retained for a period of five (5) years following the completion of the relevant project, in accordance with Danish bookkeeping regulations. Data processed based on consent is retained until consent is withdrawn. Technical logs are automatically purged after twelve (12) months.
1.6 Data Sharing and Third Parties
We do not sell, rent, or trade personal data to third parties. Personal data may be shared with the following categories of recipients solely for the purposes outlined in this policy:
- Technical service providers: hosting infrastructure, email delivery services, and analytics platforms that process data on our behalf under written data processing agreements.
- Legal and regulatory authorities: where disclosure is required by law, court order, or governmental regulation.
- Professional advisors: legal counsel, auditors, and insurance providers in connection with business operations.
1.7 International Data Transfers
Where personal data is transferred outside the European Economic Area (EEA), we ensure appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) approved by the European Commission or participation in adequacy frameworks as determined under GDPR Article 45.

- Right to Data Portability (Article 20): The right to receive your personal data in a structured, commonly used, machine-readable format.
- Right to Object (Article 21): The right to object to processing based on legitimate interests, including direct marketing.
- Right to Withdraw Consent: Where processing is based on consent, you may withdraw consent at any time without affecting the lawfulness of processing carried out prior to withdrawal.

1.9 Data Security
We implement appropriate technical and organizational measures to protect personal data against unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit (TLS/SSL), access controls, regular security assessments, and staff training on data protection obligations.
Refund Policy
3.1 Scope
This Refund Policy applies to all services provided by DesignFuseLab, registered at Frederiksgade 40, 8000 Aarhus C, Denmark. It governs the terms under which refunds may be issued for creative, consulting, and digital services.
3.2 Project Deposits
All projects require a non-refundable deposit of fifty percent (50%) of the total project fee upon acceptance of the proposal. This deposit covers initial resource allocation, concept development, and administrative processing. The deposit becomes non-refundable once work has commenced on the project.
3.3 Cancellation Before Work Commencement
If a project is cancelled in writing before any work has commenced, the deposit will be refunded in full within fourteen (14) business days. Cancellation requests must be submitted via email to [email protected].
3.4 Cancellation During Active Projects
For projects cancelled after work has commenced, refunds are calculated based on the percentage of work completed at the time of cancellation:
- If less than 25% of the project scope has been completed: a refund of seventy-five percent (75%) of the remaining balance (excluding the deposit) will be issued.
- If 25% to 50% of the project scope has been completed: a refund of fifty percent (50%) of the remaining balance will be issued.
- If more than 50% of the project scope has been completed: no refund of the remaining balance will be issued. All deliverables completed to date will be transferred to the client upon final payment.
3.5 Dissatisfaction and Revision
DesignFuseLab provides up to three (3) rounds of revisions as part of the standard project scope. If the client remains dissatisfied after the revision process has been exhausted, both parties agree to enter a good-faith mediation process to resolve the dispute before any refund claim is processed.
3.6 Refund Processing
Approved refunds are processed within fourteen (14) business days via the original payment method. DesignFuseLab is not responsible for delays caused by third-party payment processors or banking institutions.
3.7 Exceptions
No refunds will be issued for completed work that has been approved and delivered, nor for third-party costs incurred on behalf of the client (such as stock licensing, printing fees, or platform subscriptions) that have already been committed.
Terms of Service
4.1 Agreement
By accessing the website and engaging the services of DesignFuseLab, located at Frederiksgade 40, 8000 Aarhus C, Denmark, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our website or services.
4.2 Scope of Services
DesignFuseLab provides creative studio services including but not limited to brand identity design, motion design, web development, art direction, content production, packaging design, brand strategy consulting, and spatial design. The specific scope, deliverables, timeline, and fees for each project are defined in the written proposal and accepted by the client prior to work commencement.
4.3 Intellectual Property
Upon full payment of all project fees, the client receives full ownership and intellectual property rights to all final deliverables produced under the project scope. DesignFuseLab retains the right to display completed work in its portfolio and marketing materials unless otherwise agreed in writing. Preliminary concepts, sketches, and work-in-progress materials that were not selected for final delivery remain the property of DesignFuseLab.
4.4 Payment Terms
Invoices are issued according to the milestone schedule defined in the project proposal. Payment is due within fourteen (14) days of invoice date unless otherwise specified. Late payments incur a penalty of 1.5% per month on the outstanding balance. DesignFuseLab reserves the right to suspend all work on a project if payment is overdue by more than twenty-one (21) days.
4.5 Confidentiality
Both parties agree to maintain the confidentiality of all proprietary information exchanged during the course of a project. This obligation survives the termination of the agreement for a period of three (3) years. Neither party may disclose confidential information to third parties without prior written consent, except where required by law.
4.6 Limitation of Liability
DesignFuseLab's total liability under any project agreement shall not exceed the total fees paid by the client for that specific project. DesignFuseLab shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
4.7 Force Majeure
Neither party shall be liable for delays or failure to perform obligations due to circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, government actions, war, terrorism, infrastructure failures, or third-party service outages.
4.8 Termination
Either party may terminate a project agreement with fourteen (14) days written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date, calculated in accordance with the refund policy outlined in Section 3.
4.9 Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of Denmark. Any disputes arising from these terms or the services provided by DesignFuseLab shall be subject to the exclusive jurisdiction of the courts of Aarhus, Denmark.
4.10 Amendments
DesignFuseLab reserves the right to modify these Terms of Service at any time. Updated terms will be published on this page with a revised effective date. Continued use of the website or services following the publication of amended terms constitutes acceptance of the changes.
